The “Win a Trip to Jackson Hole Hill Climb” Sweepstakes

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING.

  1. PROMOTION DESCRIPTION: The “Win a Trip to Jackson Hole Hill Climb” Sweepstakes (the “Promotion”) begins on or about November 1, 2024, at 12:00:00 a.m. Pacific Time (“PT”) and ends on December 31, 2024 at 11:59:59 p.m. PT (the “Promotion Period”). For purposes of these Official Rules all times are given in Pacific Standard Time.
  2. SPONSOR: Teton Outfitters, LLC, 2818 N Sullivan Rd, Ste 110, Spokane Valley, WA 99216 (“Sponsor”).
  1. ELIGIBILITY: Open to: i) legal permanent U.S. residents of the fifty (50) United States and District of Columbia who are at least eighteen (18) years of age or older or nineteen (19) in Alabama and Nebraska and twenty-one (21) in Mississippi, or ii) a legal resident of Canada (excluding Quebec) who are at least the age of majority in their province/territory of residence at the time of entry (the “Entrant”). Officers, directors and employees of Sponsor, 509, Klim, Teton, and each of their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies involved in the execution of the Promotion (collectively “Promotion Entities”) as well as their immediate family members (spouses, siblings, children, parents, regardless of where they live) or members of the same households (whether related or not) of such officers, directors and employees are not eligible to enter. This Promotion is void in Quebec, outside of the fifty (50) United States, the District of Columbia, Canada and where prohibited by law.

By participating in the Promotion, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor which shall be final and binding in all respects.

  1. HOW TO ENTER: There are two (2) methods of entry:

Online or In-Store Purchase. Eligible Entrants who make a purchase during the Promotion Period at ride509.com or at any 509 authorized dealer are invited to enter by providing all necessary information (name, city, state, phone number, the name of the authorized dealer where Entrant made the purchase, proof of purchase, and amount spent on purchase) required via a 509 Typeform (the “Typeform”). The Typeform will be available via QR code available at every 509 authorized dealer or by visiting https://ride509.com/pages/win-a-trip-sweepstakes-terms-and-conditions. Upon completion and submission of the Typeform, Entrant will automatically be entered. Entrant will receive one (1) entry per $1USD purchased (before tax, discount, or delivery fees). All purchase entries must be received by December 31, 2024 by 11:59:59 pm PST in order to enter. All required information on the Typeform must be completed to enter and to be eligible to win. Proof of entering information on the Typeform is not considered proof of delivery to or receipt by Sponsor of such entry.

PURCHASE ENTRY MULTIPLIER OFFERS: Throughout the Promotion Period, the Sponsor may (but is not required to) offer opportunities to increase the number of online purchase entries an Entrant may receive by a multiplier, e.g., (2X), (5X), (10X) and (20X) (each an “Entry Multiplier”). When an Entry Multiplier is offered, entries will be multiplied by the applicable Entry Multiplier. For example, a $60 purchase during a 10X Entry Multiplier offer will earn 600 entries. Timing for an Entry Multiplier offer will be determined solely by the Sponsor and will be announced by the Sponsor on their Website (www.Ride509.com) and/or its social media pages.

Entrants will receive one (1) entry for each gift card purchase; however, use of a gift card to purchase does not qualify for an entry. 

If an Entrant requests a refund/exchange, the refund/exchange and cancellation of entries will be determined based on the amount of the refund/exchange and those entries will be void.

  1. Mail-In Entry. To enter via mail (available for all eligible Entrants): read these Official Rules, and then handprint in ink on a letter-size sheet of paper your full name, complete physical address and zip code, telephone number with area code, email, month and year of birth, along with the words “509 Day Gold Creek Giveaway” Sweepstakes entry. Mail your entry in a first-class stamped business-size envelope to: Teton Outfitters, LLC d/b/a 509, 2818 N. Sullivan Rd, Suite 110, Spokane Valley, WA 99216. To receive the multiplier, please include the words “MULTIPLIER” hand-written in the bottom left-hand side of the postcard and the date so that the correct multiplier can be applied to the entries. All mail-in entries must be postmarked by December 31, 2024, and received by January 9, 2025. No metered mail will be accepted. No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible, or postage-due entries or mail. Mail-in entries submitted or completed by anyone other than the Entrant are voice. No mechanical reproductions will be accepted. Limit twenty (20) entries per outer mailing envelope plus if the Multiplier and date are included then the Entrant will receive the multiplier entries.

 All entries submitted become the property of the Sponsor and will not be returned or confirmed as received.

Regardless of the method of entry, there is no limit to the number of entries per Entrant during the Sweepstakes Period.

Without limitation, Sponsor reserves the right in their sole discretion to disqualify any Entrant whose social media account that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Sweepstakes or any other person or entity; does not comply with these Official Rules; or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein. Sponsor will not verify receipt of entries for Entrants.

In the event of a dispute regarding the identity of the person who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder (defined below) of the e-mail address connected with the email account from which the entry was made. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by the Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An Entrant may be requested to provide Sponsor with proof that the Entrant is the Authorized Account Holder of the email address associated with the entry. Any attempt by any Entrant to enter this Sweepstakes using multiple/different accounts or any other methods may void the Entrant’s entries and may result in disqualification, at the sole discretion of Sponsor. Use of any automated system to participate in the Sweepstakes is prohibited and may result in disqualification. The Sweepstakes Entities are not responsible for any entry that is lost, late, misdirected or  undeliverable, whether due to system errors, omissions, interruptions, deletions, defects, delays in operation or transmissions or any other reason, theft or destruction or failures, faulty transmissions or other telecommunication malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. Late entries or entries sent via any other method than those stated above will not be accepted.

  1. WINNER SELECTION/ODDS: At the end of the Promotion Period, the grand prize winner (“Grand Prize Winner”) will be randomly selected in a drawing from all eligible entries received throughout the Promotion Period. The drawing will be conducted by Sponsor or its designee, using randomization methods selected by Sponsor in its sole discretion. Odds of winning the grand prize (“Grand Prize”) will depend upon the total number of eligible entries received during the Promotion Period. The random drawing will be conducted by a Sponsor representative, whose decisions are based upon its sole discretion and interpretation of these Official Rules and are final and binding in all respects. 
  1. GRAND PRIZE WINNER NOTIFICATION: A potential Grand Prize Winner will be notified by email or telephone via the contact information given at the time of entry. Sponsor shall have no liability for any Grand Prize Winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential Grand Prize Winner does not respond within the time period specified in the Grand Prize Winner notification, or if the Grand Prize or Grand Prize Winner notification is returned as unclaimed or undeliverable to such potential Grand Prize Winner, such potential Grand Prize Winner will forfeit the Grand Prize and an alternate Grand Prize Winner may be selected. If any potential Grand Prize Winner is found to be ineligible, or if they have not complied with these Official Rules or declines a prize for any reason prior to award, such potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner may be selected. Sponsor may successively attempt to contact up to two (2) potential Grand Prize Winners of an applicable prize in accordance with such procedure, and if there is still no confirmed Grand Prize Winner of the prize after such attempts have been made, if any, the corresponding prize may go unawarded.
  1. GRAND PRIZE CLAIM: Except where prohibited, the potential Grand Prize Winner must sign and return an affidavit of eligibility/release of liability/publicity release (the “Release”) and IRS form W-9 (US Residents) or IRS form W-8BEN (Canadian Residents) in order to claim the Grand Prize (collectively, the “Required Documents”) within the time frame indicated in the notification. Any guest of Grand Prize Winner must also complete a Travel Companion Waiver Release form. If the Grand Prize Winner is a Canadian Resident, they must correctly complete a mathematical skill testing question. If the potential Grand Prize Winner fails to sign and return the Required Documents within the required time period, or incorrectly answers the mathematical skill testing question, the potential Grand Prize Winner forfeits their right to the Grand Prize and an alternate Grand Prize Winner will be selected at random from among all remaining non-winning eligible entries received during the Promotion Period. The Grand Prize is taxable as income and the Grand Prize Winner is solely responsible for any taxes on the Grand Prize, including, but not limited to all applicable federal, state, provincial and local taxes. The Sponsor or a third party acting on behalf of the Sponsor must report the value of the Grand Prize to the IRS in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the IRS in the form of a Form 1099 for Form 1042-S. In the event it is deemed during the verification process that the potential Grand Prize Winner is not able to report the tax liability associated with acceptance of the Grand Prize, the potential Grand Prize Winner will be disqualified and another potential Grand Prize Winner will be selected from among the remaining non-winning eligible entries received during the Promotion Period.
  1. PUBLICITY RELEASE: By participating in the Promotion, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any Entrant in and/or Grand Prize Winner of the Promotion, each Entrant irrevocably grants the Promotion Entities and their respective successors, assigns and licensees, the right to use such Entrant’s name, social media tag, likeness, and biographical information, and any other personal characteristics, in any and all media for any purpose, including without limitation, to advertise, market, and promote the Promotion Entities, the Promotion or other promotions, and each Entrant and/or Grand Prize Winner hereby release the Promotion Entities from any liability with respect thereto. 
  1. PRIZES/ODDS:  One (1) Grand Prize is available. The Grand Prize consists of: i) (2) round-trip coach class airfare tickets to and from a major airport nearest the Grand Prize Winner’s residence and Jackson Hole, WY, ii) one (1) hotel room accommodation for two (2) nights, room will be a standard double occupancy room (Sponsor to determine the hotel accommodations at their discretion and is inclusive of room rate and tax only), iii) two (2) VIP tickets to hill climb viewing area, and iv) one (1) bag filled with 509 gear. Transportation during your stay and meals not included. TRAVEL NOTINCLUDED WHILE IN JACKSON HOLE, WY. The approximate retail value (“ARV”) of the Grand Prize is $2,500.  

Trip, travel, and lodging elements may be subject to change due to impracticability or unavailability, or for any other reason as determined necessary by Sponsor or its designee.  Tickets are subject to the terms and conditions of issuer and will not be replaced if lost, stolen, misplaced, damaged or destroyed. ARV may vary, depending on the point, date and time of departure. Grand Prize must be accepted as a whole or will be forfeited in its entirety. All travel arrangements must be made through a travel agent or entity selected by Sponsor. Grand Prize Winner and guest will be responsible for all meals, transportation (other than described above), travel insurance, tips, room service, laundry service, souvenirs or gratuities, fuel, parking, beverages, telephone calls, overages, baggage fees, extras and any other incidental costs or expenses not specifically stated herein as being included.  Specific air carrier(s) and other trip specifics are selected at the sole discretion of the Sponsor.  Travel must originate and end at the same major gateway airport. Grand Prize Winner and guest will be required to obtain any travel related documents and maintain all insurance (including health, liability and any other insurance along with any additional documents).  Grand Prize Winner and guest acknowledges and agrees that the Promotion Entities are not providers/carriers of transportation, or insurance providers. No changes will be made to travel details once any element(s) of the travel arrangements have been booked. No frequent flier miles will be earned on any element of prize travel.  Grand Prize conditions may be added or modified by Sponsor or its designee. Promotion Entities are not responsible for any changes of any element of the Grand Prize, nor are they liable for any expenses incurred as a consequence of flight/event changes, cancellation or delays. A Grand Winner or guest later found ineligible or non-compliant will be immediately required to return and forfeit any prize awarded. In the event Grand Prize Winner and/or guest engages in behavior that, as determined by Sponsor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, illegal or that is intended to annoy, abuse, threaten or harass any other person, or may cause harm, property damage or any other loss, Sponsor reserves the right to terminate the trip early, in whole or in part, and to send the Grand Prize Winner and guest home with no further compensation.

  1. GENERAL GRAND PRIZE CONDITIONS: Grand Prize will be awarded only if the potential Grand Prize Winner fully complies with these Official Rules. All portions of the Grand Prize are non-assignable and non-transferable. Prizes pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Promotion materials are for illustrative purposes only. Actual prize may vary from the prize pictured. All details and other restrictions of the prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. No cash alternative or substitution of the prize will be allowed, except Sponsor reserves the right in its sole discretion to substitute prize of comparable value if any prize listed is unavailable, in whole or in part, for any reason. The Grand Prize Winner shall be solely responsible for all federal, state, provincial and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. Sponsor may, in its sole discretion, deduct or withhold the amount of applicable tax on any cash or cash equivalent prize. The Sponsor will issue and file an IRS Form 1099 or 1042-S or equivalent tax withholding documentation for the retail value of any prize or other items of value transferred to the Grand Prize Winner by the Sponsor in accordance with IRS requirements, and the Sponsor may also share such documentation with a state or local government agency as required by law. Refusal or failure of the Grand Prize Winner to satisfy the requirements of all necessary and appropriate tax, withholding or other required compliance terms (including Social Security number, IRS Form W­8BEN, IRS Form W­9, or equivalent information), as determined by the Sponsor in its sole discretion, may result in the Grand Prize Winner forfeiting the prize and an alternate potential Grand Prize Winner may be selected in accordance with these Official Rules. Sponsor will award the Grand Prize subject to any applicable withholding taxes, and the amount of the prize transferred, as reduced by any applicable withholding taxes, will constitute full payment of the Grand Prize, as applicable.
  1. PUBLICITY. By accepting the Grand Prize, where permitted by law, Grand Prize Winner grants to Sponsor, and those acting pursuant to the authority of Sponsor, the right to print, publish, broadcast and use worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web at any time(s), that Grand Prize Winner name, portrait, picture, voice, likeness (as is or as may be edited, altered, or cropped), information, and biographical information as news or information and for advertising, trade, and promotional purposes without additional compensation or review.
  1. RELEASE OF LIABILITY AND AGREEMENT TO HOLD HARMLESS. All Entrants, and the Grand Prize Winner agree to release and hold harmless Sponsor and parent and subsidiary companies, affiliates, subsidiaries, officers, directors, agents, and employees; and all others associated with the development and execution of this Promotion (and agree to confirm this release and agreement to hold harmless in writing(s)) from any and all alleged and/or actual actions, demands, losses, settlements (whether or not litigation is commenced), claims, damages, liability, and costs whatsoever (including attorney fees), existing now or in the future, with respect to or in any way arising from this Promotion or participation in any Promotion-related activity, redeeming Promotion prizes, and/or delivery/mis-delivery, acceptance, possession, use, or misuse of a prize including, but not limited to, liability for personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind.

Only the stated number of prizes set forth in these Official Rules will be awarded. If, for any reason, the Promotion is not capable of running as planned due to, but without limitation, tampering, unauthorized intervention, fraud, human or other error, technical failures, or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion and to draw a Grand Prize Winner from all eligible entries received, pursuant to Rule #5, as of the date of termination. CAUTION: Any attempt to deliberately damage any Web site or to undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

  1. DISPUTES. THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE STATE OF WASHINGTON WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, each Entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, exclusively before a court located in Washington, having jurisdiction over the parties and the subject matter. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.

WINNERS LIST/OFFICIAL RULES: To obtain a copy of any legally-required winners list, send a self-addressed stamped envelope to: “Win a Trip to Jackson Hole Hill Climb” Sweepstakes Winners List, Teton Outfitters, LLC d/b/a 509, 2818 N. Sullivan Rd, Suite 110, Spokane Valley, WA 99216. All such requests must be received within six (6) weeks after the end of the Promotion Period. These Official Rules are available by sending an e-mail request to media@ride509.com with “Official Rules Request” in the subject line. Official Rules requests will not be granted after the end of the Promotion Period.
